Nevada Judge Rejects “Fake Electors” Charges Against Six Republicans

According to a spokesperson for the Nevada attorney general, a state court judge in Nevada has dismissed a criminal indictment against six Republicans who were accused of submitting false certificates to Congress, declaring Donald Trump as the winner of the state’s 2020 presidential election. This news comes after the judge reviewed the case and made the decision to dismiss the charges.

The spokesperson expressed disagreement with the judge’s decision and stated that they would be appealing immediately.

The case may have come to a close as the judge’s ruling declares that the state prosecutors made an error in choosing the wrong venue to file.

After Judge Mary Kay Holthus of Clark County District Court announced her decision, Nevada Attorney General Aaron Ford stepped into a Las Vegas courtroom and stated that he would be appealing the case directly to the state Supreme Court.

“We will be appealing immediately as we believe the judge’s decision is incorrect,” stated Ford to reporters following the ruling. He opted not to provide any further remarks on the matter.

In January, a trial for a group of defendants, which included the Nevada GOP chairman and other well-known party leaders from areas such as Las Vegas, Reno, and Lake Tahoe, was cancelled by the judge. The charges against them included offering a false instrument for filing and uttering a forged instrument, which are considered felonies and could result in a prison sentence of up to four or five years.

The defense attorneys have declared that the case is dead and have stated that bringing the case to another grand jury in a different location, such as the state capital of Carson City, would be a violation of the three-year statute of limitations on filing charges. They have noted that the statute of limitations expired in December, making it impossible to pursue the case any further.

Margaret McLetchie, the lawyer representing Jesse Law, the chairman of Clark County Republican party and one of the accused in the case, stated that “they’re done.”

In December, Nevada GOP chairman Michael McDonald was among the defendants indicted.

During the time of the indictment, Ford emphasized the importance of not letting attacks on democracy go unnoticed. He stated, “Today’s indictments are the result of a comprehensive and extensive investigation, and as we proceed with this prosecution, I have faith that our legal system will ensure justice is served.”

In 2020, seven presidential battleground states, including Nevada, witnessed the certification of false electors who claimed Trump’s victory instead of President Biden’s. This has made Nevada one of the states where the issue of fake electors has been prominent.

The states of Arizona, Georgia, Michigan, New Mexico, Pennsylvania, and Wisconsin are among the others.

Earlier this month, Trump campaigned in Nevada, which could potentially be a battleground state once again.

Legal charges have been filed in Michigan, Georgia, and Arizona for criminal offenses.
