The Department of Justice (DOJ) argued in a filing on Friday that DePape’s sentencing should not only include the recommended 25 years from the U.S. Probation Office but also an enhancement for an intent to “promote a federal crime of terrorism.”
According to the DOJ, the motive behind the attempted kidnapping was to further a federal crime of terrorism. The goal was to kidnap a Member of Congress in order to influence government actions through intimidation or coercion, or to seek revenge against government conduct. The DOJ supports their argument by referring to DePape’s statements made after his arrest. DePape explicitly mentioned that his intention was to kidnap Speaker Pelosi because she was perceived as the leader and due to his belief that there were numerous falsehoods emerging from Washington.

The Department of Justice emphasized in its recent submission that the sentencing of DePape serves as a deterrent, not only for the defendant but also for the general public. They believe it is crucial, especially in the current climate of extremism that has resulted in attacks on public and elected officials.
