The passing of an 11-year-old girl due to an allergic reaction to a bite of pizza at her school has resulted in her family filing a lawsuit.
While enjoying her lunch at de Zavala Middle School in January 2023, Cole suddenly experienced a reaction after taking a bite of pizza.
When she arrived at the nurse’s office, the nurse was not present. To address the situation, a school staff member contacted Cole’s mother and requested permission to administer Benadryl, which she agreed to, as reported by McClatchy News. Unfortunately, the young girl vomited after taking the medicine and required a breathing treatment.
According to WSBT, when Cole’s grandmother arrived at the school, the child suddenly collapsed. However, the concerned relative quickly took action and administered CPR until paramedics arrived. Cole was then rushed to the hospital for further treatment. In the wake of the tragedy, Cole’s devastated father took to Facebook to request prayers.
In January 2023, he wrote that he had been informed about a slim possibility of her survival. His words conveyed the overwhelming emotions he was experiencing, saying that he felt like he was slowly dying inside and that losing her was not an option.
Unfortunately, Cole passed away in the hospital just two days later.
After Cole’s passing, the father expressed his deep pain and grief by writing, “Emerson Kate Cole, I’ll NEVER STOP LOVING YOU. There is nothing that can ease this hurt and pain.” His words were a testament to the undying love he had for his daughter.
According to WSBT, the district is facing a lawsuit from the family of a child who passed away. The family claims that the district did not adhere to the 504 plan, and they are seeking an unspecified amount of money. Additionally, Dr. Marc Serota provided a statement in which he stated that the child’s death could have been avoided with proper care.
According to WSBT, officials from the Amarillo school district have declined to provide any comment regarding the ongoing litigation. The Independent has also reached out to the district for their perspective on the matter.
