Speaking to reporters outside the courthouse, Bannon confidently declared that his team of excellent lawyers will fight all the way to the Supreme Court if necessary. He boldly stated, “There is no prison or jail that can silence me.”
Almost two years ago, Bannon faced conviction on two counts of contempt of Congress. The first count was for his refusal to participate in a deposition with the Jan. 6 House Committee, while the second count was for his failure to provide documents related to his involvement in Trump’s attempts to overturn his loss in the 2020 presidential election to Democrat Joe Biden.
Bannon has the option to appeal his conviction to both the full U.S. Court of Appeals for the D.C. Circuit and the U.S. Supreme Court. However, according to Prosecutor John Crabb, the chances of Bannon’s conviction being overturned are slim. Crabb expressed that it is “very unlikely” that Bannon’s appeal will be successful.
According to the defense, Bannon was following the guidance of his lawyer when he received the subpoena. The attorney had advised him that the subpoena was not valid as the committee did not permit a Trump lawyer to be present in the room and Bannon could not determine the extent of the information he could provide due to Trump’s claim of executive privilege.
During the hearing, David Schoen, the defense lawyer, argued that it would be unjust to send Bannon to prison at this time because he would finish his entire sentence before he could exhaust all of his appeals. Schoen emphasized the significance of the case, stating that it raises critical constitutional issues that require the attention of the Supreme Court.
He informed reporters that in this country, individuals are not incarcerated if they believe their actions were in accordance with the law.
In March, Peter Navarro, a trade adviser who worked under Trump, began serving his four-month sentence after being found guilty of contempt of Congress. Another Trump aide who faced a similar conviction was also punished for the same offense.
Despite claiming that he could not cooperate with the committee due to Trump’s executive privilege, Navarro’s argument was deemed insufficient by courts, which found no evidence that Trump had actually invoked such privilege.
After an extensive 18-month investigation into the events of January 6th, the House Jan. 6 committee has released its final report. The report states that Trump was involved in a “multi-part conspiracy” to overturn the lawful results of the 2020 election, and failed to take any action to prevent his supporters from attacking the Capitol. These findings suggest that Trump was criminally engaged in these actions, making this an extraordinary and consequential conclusion to the investigation.
Bannon is currently dealing with legal charges in New York state court for supposedly deceiving donors who contributed funds for constructing a wall along the southern border of the United States. He has pleaded not guilty to charges of money laundering, conspiracy, fraud, and other related offenses. The trial for these accusations has been delayed until at least the end of September.
