Arkansas Governor Sarah Huckabee Sanders (R) has issued an order for the state to resist the recent updates to Title IX, which seek to provide additional safeguards for transgender students.

In an executive order signed on Thursday, Sanders expressed his disagreement with the Title IX rules recently implemented by the Education Department. According to Sanders, these rules, which broaden the definition of sex discrimination to include sexual orientation and gender identity, are “plainly ridiculous.” He believes that these rules could result in unfair competition in women’s sports, grant access to women’s and girls’ facilities, and allow males to compete for women’s scholarships.

The order mandates that schools must still abide by state laws that prohibit transgender students from using restrooms and locker rooms, as well as participating in sports teams that correspond to their gender identity. Additionally, schools are required to adhere to the 2023 Arkansas law, which prohibits public school and state employees from using a name or pronoun that does not align with a minor’s assigned sex at birth without parental permission.

During a speech at the Arkansas Capitol in Little Rock, Bernie Sanders expressed his concerns about the potential implications of Biden’s policies. Sanders highlighted the possibility of female college students having to share shower and changing facilities with male college students. He also mentioned that using biologically correct pronouns could lead to disciplinary action for harassment. Moreover, Sanders raised the issue of scholarships previously designated for women being made available to anyone claiming to be a woman.

Sanders’s executive order promises to pursue legal action against the administration if the state incurs any financial losses as a result of the implementation of the Biden administration’s unscientific agendas.

According to Sanders, there is a clear distinction between their actions and the Biden administration’s approach. He emphasized that their enforcement of state law is not an attempt to bypass the system, unlike the new guidance on Title IX issued by the Biden administration. Sanders made it clear that their intention is to uphold and abide by the law, and they expect Arkansas institutions to do the same.

The Biden administration is still in the process of finalizing a separate rule that will govern athletics eligibility.
