A woman who was hit in the head with a glass bottle while shopping at Whole Foods filed a complaint, alleging that the Midtown store failed to keep its customers safe.
Investigators say a rampaging psychopath confronted Cassidy Arkin, 49, while she was grocery shopping at the Sixth Avenue store in October.
Michael Howell, 33, allegedly attacked a 24-year-old guy outside the store with a glass bottle before going inside, getting another bottle, and slamming Arkin in front of a food counter.
He then escaped to a neighboring subway, went one stop to Rockefeller Center, and rocked a 55-year-old rider with another bottle, according to authorities.
Arkin had a severed earlobe, staples in her scalp, and was pulling glass pieces from her body.
Whole Foods failed to properly hire, monitor, and educate personnel responsible for protecting customers, she said in a Manhattan Supreme Court case filed on Wednesday.
The Harlem-based producer and director, who is seeking undisclosed damages, claims she suffered severe physical disabilities and mental suffering as a result of the incident.
Howell, an eight-time offender, is incarcerated on Rikers Island on assault charges.
The criminal case is currently pending.
Arkin and her attorney declined to respond.
Whole Foods did not respond to a request for comment.
